General conditions of use of the portal

PARQUES REUNIDOS SERVICIOS CENTRALES, S.A. (hereinafter, PARQUES REUNIDOS) with its registered office in Madrid, Recinto Parque de Atracciones, Casa de Campo, s/n and CIF A-84.885.441, registered in the Mercantile Registry of Madrid in Volume 23.506, Folio 58, sheet M-421.702, is the owner of www.aquopolis.com (hereinafter, the Portal) and makes it available to Internet users, both to provide information on products and offers from Parques Reunidos and its subsidiaries (hereinafter, PARQUES REUNIDOS GROUP), to allow the provision of different services such as ticket purchases, season passes or any other type of products through the Portal, as well as, where applicable, to provide users with various contests, games, surveys, etc. Notwithstanding the foregoing, the contracting of the different products and services offered through this portal will be carried out by the owner company of each product, whose data will always appear included in the corresponding general contracting conditions or in the respective clauses of information on personal data collection in case this occurs for a specific purpose (newsletter, contact, etc.).

These General Conditions of Use of the Portal, together with the General Conditions of Contracting that, where applicable, govern the provision of online purchase services or any other General Conditions that govern any type of tool made available to Users on the Portal, aim to regulate both the provision of information and the commercial relationships that may arise between PARQUES REUNIDOS and users of the Portal (hereinafter "Users").

By browsing the Portal and/or by using the services included therein, you become a User.

Both browsing and using any of the online purchase services on the Portal imply acceptance as a User, without any reservation of any kind, of each and every one of these General Conditions of Use of the Portal and the General Conditions of Contracting that, where applicable, govern the provision of the purchase services offered on the Portal, as well as any other General Conditions governing any type of tool made available to Users on the Portal.

PARQUES REUNIDOS may at any time and without prior notice, modify these General Conditions of Use, as well as the General Conditions of Contracting or any other General Conditions that govern any type of tool made available to Users on the Portal, by publishing such modifications on the Portal so that they may be known by Users, always before visiting the Portal or acquiring any goods, services or using any tools offered on the Portal. 

The Portal and all the contents displayed on the Portal, in particular, designs, texts, graphics, logos, icons, buttons, software, trade names, trademarks, industrial designs or any other signs capable of industrial and commercial use are subject to intellectual and industrial property rights of PARQUES REUNIDOS, PARQUES REUNIDOS GROUP (as later defined) or third-party holders who have duly authorized their inclusion in the Portal and, therefore, are protected by intellectual property laws.

Under no circumstances shall the use of the Portal by Users be understood to grant any license or waive, transfer, assign, in whole or in part, of such rights, nor shall it confer any right or expectation of right, and in particular, they may not be altered, exploited, reproduced, distributed or publicly communicated about these contents.

Access to this Portal does not grant Users any right or ownership over the intellectual property rights of the contents hosted on this Portal.

PARQUES REUNIDOS will only be liable for damages that the User may suffer as a result of using the Portal when such damages are attributable to intentional conduct by the company.

The User acknowledges and agrees that the use of the Portal, as well as the provision of the services offered therein, is carried out at their sole risk and responsibility.

PARQUES REUNIDOS is not responsible for damages that may arise from, merely enunciative and not limiting:

1. Inferences, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operational functioning of this electronic system or in the computer equipment of Users, caused by reasons beyond the control of PARQUES REUNIDOS, that prevent or delay the provision of services or navigation through the system;

2. Delays or blocks in use caused by deficiencies or overloads in the Internet or other electronic systems;

3. Damages that may be caused by third parties through illegal intrusions beyond the control and not attributable to PARQUES REUNIDOS;

4. The impossibility of providing the service or allowing access due to causes not attributable to PARQUES REUNIDOS, the User, third parties, or cases of force majeure.

PARQUES REUNIDOS does not generally control the use that Users make of the Portal. In particular, PARQUES REUNIDOS does not guarantee under any circumstances that Users use the Portal in accordance with the law, these General Conditions of Use, morality, and generally accepted good customs and public order, nor that they do so diligently and prudently. 

PARQUES REUNIDOS does not guarantee the availability and continuity of the operation of the Portal. Likewise, PARQUES REUNIDOS does not guarantee the usefulness of the Portal or its contents for carrying out any particular activity. PARQUES REUNIDOS excludes any type of liability for damages of any nature that may be due to the lack of availability or continuity of the operation of the Portal or the defrauding of the usefulness that Users may have attributed to the Portal.

PARQUES REUNIDOS guarantees that it has appropriate measures that comply with the security standards that current technology allows, such as the "Verisign" system.

Access to transactional services and those that include the capture of personal data is carried out in a secure environment using SSL (Secure Socket Layer) protocol with high security encryption of 128 bits. The secure server establishes a connection so that the information is transmitted encrypted. This ensures that the transmitted content is only intelligible to the client computer and the server of PARQUES REUNIDOS. The user can verify that they are in a secure environment if a closed padlock appears in the status bar of their browser. The security guarantee of our servers is backed by a certificate issued by the Verisign company. This certificate guarantees that the client is communicating their data to a server of PARQUES REUNIDOS and not to a third party attempting to impersonate them.

In general, the User undertakes to comply with these General Conditions of Use of the Portal, the General Conditions of Contracting (in the event that the User acquires any goods or services through the Portal), as well as comply with the special warnings or instructions for use contained therein or in the Portal and always act in accordance with the law, good customs, and the demands of good faith, using the diligence appropriate to the nature of the service enjoyed, refraining from using the Portal in any way that may impede, damage or deteriorate its normal operation, the property or rights of PARQUES REUNIDOS, GRUPO PARQUES REUNIDOS, other Users, or in general any third party.

Specifically, and without prejudice to the obligation assumed by the User in general in accordance with the preceding paragraph, the User undertakes, in the use of the Portal and, where appropriate, in the use of the online purchase tool included therein, to:

1. Truthfully provide the requested data;
2. Not to introduce, store or disseminate in or from the Portal any information or material that is defamatory, injurious, obscene, threatening, xenophobic, incites violence or discrimination on the grounds of race, sex, ideology, religion or that in any way violates morality, public order, fundamental rights, public liberties, honor, privacy or the image of third parties, the intellectual property, industrial or trade secrets of third parties, nor in general any content for which, in accordance with the law, they do not have the right to make it available to third parties and in general that in any way violates current regulations;
3. Not to introduce, store or disseminate any computer program, data, virus, code, hardware or telecommunications equipment or any other electronic or physical instrument or device that may cause damage to the Portal, any of the Services, or to any of the equipment, systems or networks of PARQUES REUNIDOS, GRUPO PARQUES REUNIDOS, any User, or in general any third party, or that in any other way is capable of causing any type of alteration or preventing their normal operation;
4. Not to carry out advertising, promotional or commercial exploitation activities through the Portal, not using the contents and in particular the information obtained through the Portal to send advertising, send messages for direct sales or for any other commercial purpose, nor to collect or store personal data of third parties;
5. Not to use false identities, nor to impersonate the identity of others in the use of the Portal or in the use of any of the purchase services of the Portal, including, where appropriate, the use of payment methods, passwords or access keys of third parties or in any other way;
6. Not to destroy, alter, use for its own use, disable or damage the data, information, programs or electronic documents of PARQUES REUNIDOS, GRUPO PARQUES REUNIDOS, or third parties.

All technical means and requirements necessary to access the Portal and the services offered therein shall be the sole responsibility of the User, as well as any expenses or taxes to which the provision of such services may give rise.

Once accessed, and to proceed with the use of the different services, the User must follow all the indications and instructions displayed on the screen, completing for this purpose the information required by the forms established on the Portal, which will imply the prior reading and acceptance of all the General Conditions of Contracting established therein.

Personal data that the User fills in during the purchase process or when requesting the services offered on the Portal, as well as any other data generated subsequently as a result of their relationship with us, will be included in files belonging to the company that owns the amusement park whose entrance the User has acquired or whose services, promotions, surveys or games they request (whose data we indicate in section 2.5.3 of this clause) and their parent company PARQUES REUNIDOS, S.A. (with registered office at Recinto del Parque de Atracciones, Casa de Campo s/n, 28011 Madrid, Spain; email: lopd@grpr.com) are joint controllers (the "Controllers"). The data will be processed for the development, maintenance and control of the relationship with us, and in particular for the management of park entry, the provision of services requested by the User, or their participation in specific promotions, surveys or games for which they have provided us with their data, as well as for processing requests that the User may direct to us, keeping communications to improve our service and for statistical purposes.

Unless the User ticks the box included in the form in which they provide their data, the Controllers are authorized to process their data to carry out surveys, send communications for advertising purposes, promotions and consumer studies by any means (including electronic media or fax), relating to products or services in the leisure sector (the amusement park sector, as well as, where appropriate, the hotel sector). This authorization includes the power of the Controllers or third parties (to whom the Controllers will not in any case transfer your data) to determine the parameters of the target audience of these informative or promotional campaigns.

To exercise their rights of access, rectification, cancellation and opposition in the legally provided terms, the User must send a written request to the Controllers at the address or email indicated in this clause, indicating in the subject line "ARCO Request- Marketing Department" and attaching a copy of a document that proves their identity.

IF THE USER IS UNDER 14 YEARS OF AGE, THEY NEED THE CONSENT OF THEIR PARENTS. To do this, we will contact them and ask them to confirm that they are their parents or guardians and their consent, and at that time, we can accept their request.

For the purposes of this clause, GRUPO PARQUES REUNIDOS currently includes the following companies, mainly dedicated to the management of leisure parks: Parques Reunidos, S.A., Parques Reunidos Valencia S.A.U. in liquidation, Leisure Parks, S.A., Parques de la Naturaleza Selwo S.L., Zoos Ibéricos, S.A., Parque de Atracciones San Fernando de Henares, S.L.U., Aquopolis Cartaya, S.L., Madrid Theme Park Management, S.L.U., Travelparks Viajes, S.L.U. Additionally, in the European Union / European Economic Area, GRUPO PARQUES REUNIDOS currently includes the following operational companies exclusively in the leisure sector (leisure parks, water parks, cable cars, zoos, etc.): Bobbejaanland B.V.B.A., and Travelparks BVBA (Belgium), Bon-Bon Land A/S (Denmark), TusenFryd A/S (Norway), BoSommarland A/S (Norway), Marineland, SAS, LB Investissement S.A. SAS Travelparks, and Delphinus, SAS (France), Grant Leisure Group, Ltd. and Real Live Leisure Company Ltd (United Kingdom) and Parco Della Standiana, S.r.L. (Italy).

All Spanish companies have their registered office at Recinto Parque de Atracciones Casa de Campo s/n.- 28011 Madrid, except Zoos Ibéricos S.a., whose address is Parque Zoológico, Casa de Campo, 28011 – Madrid and Parques Reunidos Valencia S.A.U. in liquidation, whose address is L´Oceanográfic, Junta de Murs i Valls, s/n .Valencia. The non-Spanish companies have the following addresses: Tusenfryd AS 1407 Vinterbro, Norway, Delphinus SAS at 2 Route de la Brague Lotissement du Domaine de la Brague 06 600 Antibes (France); SAS LB Investissement S.A at Boulevard de la Mer 62520 Le Touquet Paris Plage, Marineland, SAS and SAS Travelparks at 2 Route de la Brague Lotissement du Domaine de la Brague 06 600 Antibes (France), Bon-Bon Land A/S Gartnervej 2, Holme-Olstrup, 4684 Holmegaard (Denmark); Bobbejaanland B.V.B.A. and Travelparks BVBA at Olensteenweg 45, 2460 Kasterlee, Lichtaart (Belgium); Parco Della Standiana S.R.L. at Loc. These General Conditions of Use will be governed by Spanish law, which will apply in everything not provided for in this contract regarding interpretation, validity, and execution.

The parties expressly waive the jurisdiction that may correspond to them and expressly submit to the Courts and Tribunals of Madrid to resolve any controversy that may arise in the interpretation or execution of these conditions.
